TERMS OF USE, REPAIR, QUOTATION, STORAGE & UNCOLLECTED GOODS TERMS AND CONDITIONS

Last Updated: 10 May 2025  Welcome to Techpriest.co.za (“Tech Priest”, “we”, “us” or “our”).By accessing or using the Tech Priest website, submitting equipment or other property to Tech Priest for inspection, diagnosis, quotation, repair, upgrade, maintenance, servicing or any other work, or authorising work verbally, electronically or in writing, the Customer agrees to be bound by these Terms and Conditions.These Terms and Conditions are governed by the laws of the Republic of South Africa and must be read subject to applicable legislation, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Protection of Personal Information Act 4 of 2013 (“POPIA”), and applicable South African common law.Nothing in these Terms and Conditions is intended to exclude, restrict or waive any right, protection, warranty, remedy, duty or liability that cannot lawfully be excluded, restricted or waived under South African law.

1. Definitions and Acceptance of Terms

For purposes of these Terms and Conditions:“Tech Priest” means Tech Priest, including, where applicable, its owners, directors, employees, authorised representatives, agents, contractors and associates acting within the scope of their authority.“Customer”, “you” or “your” includes:
  • the person who owns an Item;
  • the person who possesses or submits an Item to Tech Priest;
  • the person requesting a quotation, diagnosis, repair, upgrade, maintenance, servicing or other work;
  • the person authorising work verbally, electronically or in writing; and
  • any third-party person, representative, employee, agent, family member, courier, contractor or other person acting for, on behalf of, or with the authority or apparent authority of the Customer.
“Item” includes any equipment, computer, laptop, desktop, mobile device, peripheral, component, storage device, accessory or other property submitted to Tech Priest.By accessing this website, submitting an Item, requesting a quotation, authorising work or otherwise using Tech Priest's services, the Customer acknowledges that they have read, understood and agreed to these Terms and Conditions.

Third Parties Acting on Behalf of a Customer

Where a third party submits an Item to Tech Priest, requests a quotation, provides instructions, authorises work, approves additional work, receives communications, makes payment, collects an Item or otherwise acts on behalf of the Customer, that person shall, to the extent permitted by applicable law, be deemed to have acknowledged and accepted these Terms and Conditions on behalf of the Customer.The Customer is responsible for ensuring that any person acting on the Customer's behalf has the necessary authority to do so.Tech Priest may reasonably rely upon instructions, authorisations and representations made by a person who appears to be acting on behalf of the Customer, unless Tech Priest has actual knowledge that such person lacks authority or there are reasonable grounds to suspect otherwise.Where a third party acts without the Customer's authority, the Customer and/or the third party may remain responsible for any resulting consequences, costs or liabilities to the extent permitted by South African law.Nothing in this clause removes or limits any statutory right or protection available to a consumer under applicable South African legislation.Where the Customer is a consumer protected by the CPA, these Terms and Conditions shall be interpreted subject to the Customer's statutory rights and protections.

2. Services

Tech Priest provides IT support, computer repairs, diagnostics, upgrades, maintenance, servicing, software-related services, hardware repairs, technical services, quotations and related technology services.Services may include, without limitation:
  • diagnosis and fault finding;
  • inspection and assessment;
  • repair and maintenance;
  • hardware replacement;
  • upgrades;
  • software installation or configuration;
  • component replacement;
  • cleaning and servicing;
  • data-related services;
  • quotations and estimates; and
  • other technical services agreed between Tech Priest and the Customer.
Tech Priest reserves the right to decline a repair or service where, in its reasonable opinion, the Item is unsafe, uneconomical to repair, excessively damaged, obsolete, incompatible, contaminated, illegally obtained, subject to a third-party claim, or otherwise unsuitable for the requested work.

3. Application of These Terms to All Items

These Terms and Conditions apply to ALL Items submitted to Tech Priest, irrespective of whether the Item is ultimately:
  • repaired;
  • upgraded;
  • serviced;
  • maintained;
  • diagnosed;
  • inspected;
  • tested;
  • quoted on;
  • returned without repair;
  • repaired pursuant to a written quotation;
  • repaired pursuant to a verbal authorisation; or
  • otherwise worked on or held by Tech Priest at the Customer's request.
The Customer acknowledges that the submission of an Item to Tech Priest creates an agreement for Tech Priest to receive and hold the Item for the agreed purpose, subject to these Terms and Conditions and applicable law.

4. Customer Ownership and Authority

The Customer warrants and represents that:
  1. the Customer is the lawful owner of the Item; or
  2. the Customer has full legal authority and permission from the lawful owner to submit the Item to Tech Priest and to authorise inspection, diagnosis, repair, upgrade, modification or other work.
The Customer accepts responsibility for any dispute concerning ownership, possession, title, authority or the right to have the Item repaired or otherwise dealt with.To the extent permitted by law, the Customer indemnifies Tech Priest against claims, losses, liabilities, damages, costs or expenses arising from a third-party allegation that the Customer did not have lawful ownership, possession or authority in respect of the Item.Tech Priest reserves the right to refuse to release or otherwise deal with an Item where there is a genuine dispute concerning ownership or legal entitlement until the dispute is resolved or lawful instructions are received.

5. Quotations and Authorisation of Work

Quotations are estimates based on the information available and the condition of the Item reasonably ascertainable at the time of inspection.The final repair cost may differ from the initial quotation where:
  • additional faults are discovered;
  • hidden damage is discovered;
  • additional parts or labour are required;
  • the condition of the Item differs materially from that initially represented;
  • parts become unavailable or increase in price;
  • additional work is requested by the Customer; or
  • further work is reasonably necessary to complete the authorised repair.
Where required by applicable law, Tech Priest will obtain the Customer's authorisation before undertaking additional chargeable work.Authorisation may be provided verbally, electronically or in writing, provided that Tech Priest may record or document such authorisation for its records.Electronic communications, including email, WhatsApp, SMS or other electronic communications between Tech Priest and the Customer, may constitute evidence of instructions, approval or authorisation, subject to applicable law.

6. Payment and Right of Retention

Unless otherwise agreed in writing, all amounts owing to Tech Priest are payable upon completion of the relevant work and before the Item is released to the Customer.Amounts owing may include, where applicable:
  • diagnostic charges;
  • quotation or assessment charges;
  • labour;
  • replacement parts;
  • components;
  • software or licensing charges;
  • transport or courier charges;
  • additional authorised work;
  • collection or delivery charges;
  • storage charges; and
  • other agreed or lawfully incurred charges relating to the Item.
Subject to applicable law, Tech Priest may retain possession of an Item until all amounts lawfully owing in respect of the Item have been paid.

7. Storage Charges for Uncollected Items

Once an Item has been repaired, assessed, quoted, completed or otherwise made available for collection, Tech Priest will notify the Customer using the contact details supplied by the Customer.The Customer is responsible for collecting the Item and settling all outstanding amounts within the applicable collection period.

Storage Fee

A storage charge of R20.00 (Twenty Rand) per day will apply to an Item that remains uncollected and/or unpaid.The storage charge will commence on the 5th business day following the date on which the Customer was notified that the Item is ready for collection and/or that payment is due, unless otherwise agreed in writing.For purposes of these Terms and Conditions, a business day means Monday to Friday, excluding official public holidays in the Republic of South Africa.The R20.00 daily storage charge is payable over and above:
  • repair costs;
  • labour charges;
  • replacement parts;
  • components;
  • diagnostic charges;
  • quotation or assessment charges;
  • authorised upgrades;
  • other authorised work; and
  • any other amounts lawfully due.
Storage charges will continue to accrue until the Item is collected and all outstanding amounts are paid, or until the Item is lawfully sold, recycled, scrapped, dismantled, disposed of or otherwise dealt with in accordance with these Terms and Conditions and applicable South African law.Tech Priest may send reminders to the Customer; however, the failure to send an additional reminder does not automatically waive storage charges that have lawfully accrued.

8. Outstanding Payments and Arrears

If the Customer fails to settle outstanding amounts relating to:
  • repairs;
  • upgrades;
  • replacement parts;
  • labour;
  • quotations;
  • diagnostics;
  • inspections;
  • authorised work;
  • verbally authorised work;
  • electronically authorised work;
  • written authorised work; or
  • storage charges,
such amounts shall remain due and payable.The Customer remains responsible for all charges lawfully incurred, notwithstanding that the Customer later decides not to proceed with a repair or fails to collect the Item.A Customer's failure to collect an Item does not, by itself, cancel or extinguish charges lawfully incurred.

9. Uncollected Items and Final Notice

Tech Priest will make reasonable efforts to notify the Customer that an Item remains available for collection and/or that outstanding amounts remain payable.Where an Item remains unpaid or uncollected, Tech Priest may issue one or more reminders or a final written notice.Such communication may be sent using the contact details supplied by the Customer, including by:
  • email;
  • WhatsApp;
  • SMS;
  • telephone communication;
  • registered or ordinary post; or
  • another reasonably appropriate method of communication.
The final notice may include:
  • details identifying the Item;
  • the outstanding repair, labour, parts, quotation or other charges;
  • accumulated storage charges;
  • any other lawful amounts due;
  • a deadline for payment and collection; and
  • the possible consequences of continued failure to pay and collect the Item.


10. Items Remaining Uncollected for Three Months

Where an Item remains unpaid and uncollected for a period of three (3) months after the Customer has been notified that the Item is ready for collection and/or that payment is due, Tech Priest may, subject to applicable South African law and any mandatory consumer rights:
  1. regard the Item as unclaimed or abandoned for the purpose of exercising its lawful rights and remedies;
  2. exercise any applicable lien or lawful right of retention;
  3. take reasonable steps to recover amounts lawfully owing;
  4. arrange for the Item to be sold or otherwise disposed of in a commercially reasonable manner, where legally permitted;
  5. recycle, scrap or dismantle the Item where it has little or no reasonable resale value or where such action is otherwise lawful;
  6. retain, reuse or repurpose usable parts or components where legally permitted; or
  7. take any other lawful action reasonably necessary to recover outstanding costs and expenses.
Nothing in this clause creates an automatic transfer of ownership where such transfer would not be legally valid.Any sale, disposal, recycling, scrapping, dismantling or other dealing with an Item shall be carried out only to the extent permitted by South African law and, where required, after reasonable notice or compliance with any applicable legal procedure.Where an Item is lawfully sold, the proceeds may be applied towards:
  1. repair costs;
  2. labour;
  3. replacement parts and components;
  4. diagnostic or quotation charges;
  5. accumulated storage charges;
  6. reasonable costs of preservation, collection, storage, sale or disposal; and
  7. other amounts lawfully owing to Tech Priest.
Where applicable law requires a surplus to be accounted for or returned to the lawful owner, Tech Priest will deal with such surplus in accordance with applicable law.

11. Abandoned, Unclaimed and Unpaid Items

Where an Item remains unpaid and uncollected for three (3) months, despite reasonable notification and opportunity for the Customer to pay the outstanding amounts and collect the Item, the Customer acknowledges that Tech Priest cannot reasonably be expected to store the Item indefinitely.Subject to applicable South African law, Tech Priest may treat the Item as unclaimed or abandoned for purposes of exercising its lawful remedies and recovering outstanding costs.To the maximum extent permitted by law, the Customer authorises Tech Priest to lawfully:
  • sell the Item;
  • use the proceeds to defray outstanding expenses;
  • dismantle the Item;
  • retain or reuse usable components;
  • use components in other repairs;
  • recycle or scrap the Item or components;
  • donate the Item or usable components; or
  • otherwise dispose of the Item in a lawful and commercially reasonable manner.
The Customer acknowledges that, where lawful disposal or sale takes place following the applicable notice and legal process, Tech Priest may use the proceeds or value recovered to defray repair costs, labour, parts, storage charges and other amounts lawfully due.Nothing in this clause requires Tech Priest to retain an Item indefinitely or prevents Tech Priest from exercising any lawful right available to it.Nothing in this clause overrides statutory consumer rights, ownership rights recognised by law, a court order or any mandatory legal requirement.

12. Data and Personal Information

The Customer remains responsible for backing up all important data before submitting an Item to Tech Priest.The Customer should remove confidential, sensitive or personal information where reasonably possible before submitting an Item.Where reasonably necessary to perform the requested service, Tech Priest may access data stored on the Item.Where an Item is lawfully sold, recycled, scrapped, dismantled or otherwise disposed of, Tech Priest may take reasonable steps to erase, remove, destroy or otherwise deal with data contained on the Item, subject to applicable law.Personal information will be processed in accordance with applicable South African privacy legislation, including POPIA.

13. Care, Risk, Loss, Damage and Theft

Tech Priest will take reasonable care of Items in its possession and will exercise the degree of care required by applicable South African law.However, subject to applicable law, Tech Priest will not be liable for loss, damage or failure arising from:
  • circumstances beyond Tech Priest's reasonable control;
  • inherent or latent defects;
  • pre-existing damage;
  • deterioration;
  • corrosion;
  • normal wear and tear;
  • defective or failing batteries;
  • defective components;
  • failures arising from the existing condition of the Item;
  • unavoidable failure during reasonable diagnostic or repair procedures;
  • data corruption or loss, except to the extent caused by conduct for which Tech Priest is legally liable; or
  • any other event or circumstance for which Tech Priest cannot lawfully be held responsible.
Nothing in these Terms and Conditions excludes or limits Tech Priest's liability where such exclusion or limitation is prohibited by law.Tech Priest does not exclude liability arising from a failure to exercise the degree of care required by applicable law where such liability cannot lawfully be excluded or limited.

14. Pre-Existing Damage and Condition of Items

The Customer acknowledges that an Item may contain pre-existing faults, damage, wear, missing components, liquid damage, electrical faults, defective batteries, software corruption, malware, viruses, defective storage devices or other conditions that may not be immediately apparent.Tech Priest will not be responsible for pre-existing faults or damage that were not caused by Tech Priest.Where reasonably practicable, Tech Priest may record the condition of an Item when received.The Customer acknowledges that diagnostic or repair procedures may reveal additional faults or result in the failure of an already defective component.Where such failure results from the pre-existing condition of the Item or the inherent risks of reasonable diagnostic or repair procedures, and not from a failure by Tech Priest to exercise reasonable care and skill, Tech Priest shall not be liable for such failure.

15. Data Loss and Backups

The Customer acknowledges that repairs, upgrades, diagnostics, formatting, operating system installation, software repairs, component replacement and other technical procedures may result in data becoming inaccessible, corrupted or lost.The Customer is responsible for maintaining appropriate backups of all important information before submitting the Item.Unless specifically agreed otherwise in writing, Tech Priest does not guarantee the preservation, recovery or restoration of data.Nothing in this clause excludes liability that cannot lawfully be excluded under South African law.

16. Removed or Replaced Parts

Where parts or components are removed or replaced during repairs, such parts will be dealt with in accordance with the agreed repair terms and applicable South African law.Where the Customer is legally entitled to the return of removed parts, Tech Priest will comply with applicable legal requirements.

17. Repair Warranties

Tech Priest will honour warranties and obligations applicable under South African law.Where the CPA or other legislation provides statutory rights or warranties in relation to repairs, services, replacement parts or goods, these Terms and Conditions do not exclude those rights.Any additional warranty provided by Tech Priest may be subject to separate written warranty terms.

18. Limitation of Liability

To the maximum extent permitted by South African law, Tech Priest shall not be liable for indirect, consequential, special or purely economic losses arising from the use of its website or services, including loss of profits, business interruption or loss of opportunity.Nothing in these Terms and Conditions shall:
  • exclude or restrict any right that cannot lawfully be excluded;
  • exclude a mandatory statutory warranty;
  • deprive a consumer of rights available under the CPA or other applicable legislation;
  • exclude liability for gross negligence or wilful misconduct where such exclusion is prohibited by law; or
  • prevent a Customer from exercising a lawful statutory remedy.


19. Customer Indemnity

To the extent permitted by law, the Customer indemnifies Tech Priest, its directors, employees, authorised representatives and agents against claims, losses, liabilities, damages, costs and expenses arising from:
  • the Customer's lack of lawful ownership or authority over an Item;
  • fraudulent or unlawful submission of an Item;
  • third-party ownership claims resulting from the Customer's actions or representations;
  • false or inaccurate information supplied by the Customer;
  • unlawful or unauthorised instructions given by the Customer; or
  • the Customer's breach of these Terms and Conditions.
This indemnity does not apply to the extent that the relevant loss was caused by Tech Priest's unlawful conduct or where such indemnity would be prohibited by applicable law.

20. Website Use

You agree not to:
  • use the website for an unlawful purpose;
  • attempt to obtain unauthorised access to the website, servers or systems;
  • interfere with the operation or security of the website;
  • introduce malicious software or code;
  • copy or reproduce protected content without permission; or
  • use the website in a manner that infringes the rights of Tech Priest or any other person.


21. Intellectual Property

All content on the Tech Priest website, including text, graphics, logos, photographs, designs, software and other materials, is owned by Tech Priest or its licensors and is protected by applicable intellectual property laws.No content may be reproduced, modified, distributed or commercially exploited without appropriate permission.

22. Third-Party Websites

Tech Priest may provide links to third-party websites.Tech Priest does not control those websites and is not responsible for their content, availability, security, privacy practices or terms and conditions.Use of third-party websites is at the user's own risk.

23. Electronic Communications

The Customer agrees that Tech Priest may communicate with the Customer using the contact details supplied, including:
  • email;
  • WhatsApp;
  • SMS;
  • telephone;
  • other electronic communication platforms; or
  • other reasonable methods of communication.
Communications may include:
  • quotations;
  • repair updates;
  • requests for authorisation;
  • approval of additional work;
  • invoices;
  • payment reminders;
  • collection notifications;
  • storage notifications;
  • final notices; and
  • other communications relating to the Item or services.
Electronic communications may constitute evidence of communications, instructions, authorisations and agreements, subject to applicable South African law.

24. POPIA and Personal Information

Tech Priest will process personal information in accordance with applicable South African privacy legislation, including POPIA.The Customer confirms that personal information supplied to Tech Priest may lawfully be provided and processed for the purpose of providing the requested services.Where an Item contains personal information belonging to the Customer or another person, the Customer authorises Tech Priest to access such information only to the extent reasonably necessary to diagnose, repair, test, configure or otherwise provide the requested service.

25. Changes to These Terms and Conditions

Tech Priest may amend or update these Terms and Conditions from time to time.The version published on the Tech Priest website at the relevant time will apply, subject to applicable law.Where a repair, quotation or service has already been agreed under separate written terms, those terms may continue to apply to that transaction.No amendment will retrospectively remove or reduce any mandatory statutory right of a consumer.

26. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a competent court or authority, that provision shall be severed or modified only to the extent necessary.The remaining provisions shall continue in full force and effect to the extent permitted by law.

27. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of South Africa.The parties should, where reasonably possible, attempt to resolve disputes amicably before commencing formal legal proceedings.Nothing in these Terms and Conditions prevents a Customer from exercising any statutory right to approach a relevant consumer authority, ombud, tribunal, regulator or court.Any legal proceedings shall be subject to the jurisdiction of the appropriate South African court in accordance with applicable law.

28. Consumer Protection

Where the Customer qualifies as a consumer under the Consumer Protection Act 68 of 2008, these Terms and Conditions must be interpreted together with the CPA.Nothing contained in these Terms and Conditions is intended to waive, exclude, restrict or diminish any consumer right where doing so would be unlawful.Where a provision of these Terms and Conditions conflicts with a mandatory provision of South African law, the applicable law shall prevail.

29. Entire Agreement

These Terms and Conditions, together with any applicable quotation, invoice, job card, repair authorisation, written agreement or other document expressly incorporated into the transaction, constitute the agreement between Tech Priest and the Customer in relation to the relevant services and Item.

30. Customer Acknowledgement

By submitting an Item to Tech Priest for repair, diagnosis, quotation, upgrade, maintenance, servicing or any other technical service, the Customer acknowledges and agrees that:A. The Customer has read, understood and accepted these Terms and Conditions.B. The Customer is the lawful owner of the Item or has lawful authority from the owner to submit the Item and authorise the requested work.C. The Customer accepts responsibility for all charges lawfully incurred in relation to authorised services.D. A storage charge of R20.00 per day may apply from the 5th business day after notification that the Item is ready for collection and/or that payment is due.E. Storage charges are payable over and above repair costs, parts, labour, diagnostic charges, quotation charges and other lawful charges.F. Failure to pay and collect an Item within three (3) months may result in Tech Priest exercising its lawful rights and remedies, including lawful retention, sale, recycling, scrapping, dismantling, reuse, donation or disposal of the Item, subject to applicable South African law and any required notice or legal process.G. Where an Item is lawfully sold or otherwise disposed of for value, the proceeds or value recovered may be applied towards repair costs, labour, parts, storage charges and other lawful amounts owing, subject to applicable law.H. The Customer is responsible for backing up important data before submitting the Item.I. Tech Priest will take reasonable care of Items in its possession but shall not be liable for loss, damage, theft or failure except to the extent that Tech Priest is legally liable under applicable South African law.J. Nothing in these Terms and Conditions removes or limits any mandatory statutory right or remedy available to the Customer.K. Third Parties Acting on Behalf of the Customer: Where an Item is delivered, submitted, collected or otherwise dealt with by a third party acting for or on behalf of the Customer, the Customer acknowledges that such person is acting as the Customer's representative. Any third party who submits an Item, requests a quotation, provides instructions, authorises work, accepts or approves a quotation, approves additional work, makes payment, receives communications or collects an Item on behalf of the Customer shall, to the extent permitted by applicable law, be deemed to have acknowledged and accepted these Terms and Conditions on behalf of the Customer.L. The Customer remains responsible for ensuring that any person acting on the Customer's behalf has the necessary authority to do so. Tech Priest may reasonably rely upon the representations, instructions and authorisations of a person who appears to have authority to act on behalf of the Customer, unless Tech Priest has actual knowledge, or reasonable grounds to believe, that such person lacks authority.
